Department of Education Requests Public Commentary

The US Department of Education is requesting information on race and the disproportionate identification, placement, and discipline of children with disabilities. The Department would like to know what kinds of actions it should take when it comes to the significant disproportion based on race and ethnicity in: (1) the identification of children as children with disabilities, which includes identification by disability category; (2) placement of children with disabilities in a particular educational setting; and (3) and the incidence, duration, and type of disciplinary action taken with respect of children with disabilities. The Department would also like to know what kinds of action should it take to ensure that funds that are reserved for comprehensive and coordinated early intervention services (under Part B of IDEA) are used to address significant disproportion.
